This work is a partial comment to the sentence issued in the civil case where three of the victims of the Fr. Fernando Karadima sued the "Catholic Church of Chile" for the damages suffered due to his negligence in the reaction face with the sexual and conscientious abuses committed by said priest. However, this comment does not address the underlying issue debated, that is, whether it was appropriate or not to accept such compensation claim against the "Catholic Church of Chile", represented by the Archbishopric of Santiago, for its responsibility as a cover for the abuses committed by this priest, but focuses on an incidental point and that has interest to procedural law. The purpose is to determine what is the procedural legitimization of the Catholic Church in the Chilean law, to demonstrate that it does not enjoy a procedural privilege when it demands or is sued institutionally.
