This work contends that the conception, sustained by the Freedom of Information Agency, that public officials have a reduced right to privacy, not only contradicts what is stated by the Constitution and the Freedom of Information Act but also what has been affirmed by the Constitutional Court and other High Courts. Likewise, we assert that the conception under criticism here is weak at the light of its own assumptions, among other reasons, because it does not contribute to the purposes of the right to freedom of information in which such idea is said to be based.
