The Chilean Supreme Court recently issued the final judgment in Case No. 31.179-2015, in which, in our view, it held a doctrine that rectifies a severe mistake incurred by the Second Environmental Court (Case No. D-13-2014), when accepting a motion to dismiss based on lack of subject-matter jurisdiction. Indeed, as it will be explained, in our view, the Second Environmental Court had issued a judgment (which was confirmed by the Court of Appeals of Santiago, Case No. 5-2015) which showed a considerable confusion regarding the implementation of the rules governing the liability for environmental damage in our country.
