The Court for the Defence of Free Competition plays a fundamental role in preserving and promoting free competition in both regulated and non-regulated markets, given its competence to know about any controversy related to acts that may actually or potentially restrict this legal right, including those involving State Administration Bodies. Therefore, it is important to avoid ambiguous terminology, such as “Energy Contention Tribunal,” as such ambiguities can lead to unproductive disputes in both contentious and non-contentious matters. These misunderstandings may delay the Court’s resolutions or judgments intended to ensure social welfare and economic efficiency in the markets. Consequently, the decisions made by the Court are vital to ensuring that the actions of any market agent do not harm competition.
