The article reconstructs the foundations upon which Luigi Ferrajoli develops his proposal A Constitution for the Earth, based on the main criticisms faced by constitutional paradigms beyond the State. Qualifying the project as a «realistic utopia», the topics of the universality of human rights, legal pluralism, and the theory of democracy supporting Ferrajoli’s work are discussed. The article highlights some critical knots in the proposal that impact its motivational dimension.
