The controversy about the incorporation of the recognition of indigenous peoples and their rights in constitutions has been one of the central debates of multiculturalism in recent decades. In this context, this paper offers a comprehensive review of the constitutionalisation of indigenous peoples’ rights across the continent, emphasising the interpretative practice of the constitutional courts. Based on this literature, this paper examines the Chilean case and develops the tensions that the country’s infra-constitutional regulations have had to deal with to recognise the differentiated rights of indigenous peoples and, thus, allow a degree of integration of the indigenous multiculturalism into Chilean law.
