This work studies the guarantee and comprehensive protection, the effective exercise and full enjoyment of the right of children and adolescents to actively participate in family mediation processes in Chile, in light of Law No. 21,430, on Guarantees and Comprehensive Protection of the Rights of Children and Adolescents. The author proposes to analyze the current regulatory framework in accordance with the international standards derived from the Convention on the Rights of the Child, through the application of the dogmatic method, with the purpose of contributing to the recognition of children and adolescents as subjects with rights. It is concluded that the regulatory regulation of family mediation in Chile is insufficient to guarantee the real and effective participation of children and adolescents, and its adaptation is considered essential in accordance with existing international human rights standards on the matter.
