The purpose of this commentary is to analyze the sentence of the Supreme Court of Chile of the year 2020 which, based on a literal interpretation of art. 1 of Act 103-2018, rejects the idea that the conduct of the accused constitutes sexual harassment. This will make it possible to defend the predominance of the systematic interpretation of the norm in conjunction with the conceptual application of international organizations, the doctrine and the norms of other legal systems, in order to obtain a reasoning according to the usual use and understanding of sexual harassment.
