Starting from the discussion of the “supermarket case” on the distinction between agreements and concerted practices, the article attempts to properly differentiate these concepts. First, it critically analyzes national and foreign doctrine on the subject. Second, it delivers a vision regarding the distinction based upon Oliver Black’s work. Third, it analyzes the implications of this model.
