In the ongoing Latin America music business there is a contemporary controversy around the inclusion of managers, A&Rs and so-called executive producers as the false right holders of co authorship over musical works. This trend represents a challenge to the founding principles of Copyright Law in the Colombian context since those agreements between real authors and non-authors could be an unlawful agreement. In this paper we will try to address this issue by solving the question: Is it lawful to include non-authors in the distribution of rights over a musical work? The purpose is to analyze this phenomenon in order to give an academic answer to a question that may affect the exercise of the rights artists have over their own work.
