This paper analyses the qualifying authority of the real estate registrar and how it is enshrined within the Chilean registry’s procedure. The system’s features, based on a registry’s system of inscription and not transcription, justify the need for such an analysis. This study is more even more relevant if one considers the significant effects that flow from the registry’s system. This paper is divided as follows. First, the qualifying authority of the real estate registrar is characterised by giving special attention to its concept, scope, legal basis and nature. Second thee paper moves on to study the registry’s procedure, that is the legal acts that must be progressively deployed to be able to carry out an inscription. Thus, the paper critically engages with the case law and legal scholarship so as to give account of the main stages of the procedure. The paper closes with a set of conclusions.
