This article proposes a critical analysis of the regulation of the crime of femicide in Chile. It will analyze the dogmatic foundations of the criminal type in Chilean legislation and its relationship with the mitigating circumstance of rapture and obsession. To do so, we will present the discussion of this mitigating factor in relation to the case of Marco Olmos Barraza, heard by the Oral Criminal Court of Ovalle, accused of committing the crime of frustrated femicide against his spouse. To conclude, we will present a critical look at Article 390 quinquies of the Chilean Criminal Code and some of the problems raised by the provision.
