The article addresses two of the least developed issues regarding the crime of disobedience of judicial resolutions in Chile. On the one hand, it critically reviews the premise -usually assumed by the scarce doctrine that has addressed the issue-that the criminal offense applies only to cases of non-compliance with sentences that determine definitive or temporary effects, an aspect that is especially relevant concerning the treatment that should be given to the non-compliance of precautionary measures. On the other hand, the main problems that could arise in practice to criminal liability in this crime are analyzed, as well as the treatment of the liability of individuals who are not personally bound by the respective court resolution. In this regard, the nature of this crime will be discussed in particular to show that a person "not bound" by the judicial decision, although he could not be considered a "perpetrator" —primary parties—, could still be held liable as an accomplice —secondary parties—.
