In this paper we critically review the Constitutional Court’s ruling on the controversy originated by the Pascua Law case. We propose a combination of diverse theoretical and legal approaches to examine these cultural controversies. By enriching the conceptualization, a better political, jurisdictional and constitutional understanding of the case of women as a minority within minorities is favored.
