The main objective of this work is to analyze the extrajudicial and judicial mechanisms for access to environmental justice existing in Chile with a view to determining if they are sufficient and allow effectively satisfying the right to effective judicial protection of the human right to enjoy an environment without risks, clean, healthy and sustainable. It is then that, based on legal dogmatics as the main method, together with the technique of documentary analysis, we will consider as a hypothesis that the extrajudicial and judicial mechanisms for access to environmental justice in Chile, although they have experienced legislative progress, those are not enough, in such a way that there is still room to improve effective judicial protection of the environment. It is argued that there is still fertile ground to advance in the realization of this right, both in terms of corporate mechanisms, which allow solving the environmental conflict in the private sphere, and the improvement of state mechanisms for solving environmental disputes.
