This paper analyzes the scheme of bilateral agreements on access to genetic resources and the fair and equitable sharing of the benefits derived from their use, created by the Convention on Biological Diversity (CBD) and implemented by the Nagoya Protocol (PN). The main features of this scheme are identified, their advantages and disadvantages. Finally, the main challenges presented the bilateral approach mechanism are pointed out, in order to fulfill the objectives of these international treaties.
