The study on chilean jurisprudence that has resolved cases in which “unintentional dolus” has been dealt with, especially eventual intent, allows to conclude the existence, on one hand, of successes and progress regarding court decisions; and on the other hand, it requires to give notice of important shortcomings and problems in the jurisprudential attempt to define this kind of criminal intent and negligence.
