This paper analyses the crime of arms trafficking typified in the Law No. 17.798, proposing an interpretation of it as a crime of abstract danger. This interpretation is framed within a general regime of firearms access prohibition for private individuals and where, as a rule, the management of these elements outside of the control system is penalized. Thus, through an analysis and definition of the ratio legis considerations behind the criminalisation of firearms trafficking, an analytical exercise of deconstruction of the concepts referring to the matter and of the considerations of the content of illegality of the material object sanctioned, the legally protected value and the crime’s typification technique used, we will propose a solution for the interpretative problems that have originated in the jurisprudence regarding this criminal definition, in particular, regarding the behaviors of offering and celebrating conventions. In this way, an interpretation that defines the scope of allowed risk will be settled and, consequently, of the behaviors of offering and celebrating conventions that are in fact sanctioned by the legislator.
