This paper analyzes the judgment pronounced by the Supreme Court, dated January 4, 2021, in case roll no 5493-2020, entitled "Z. with Talcahuano Health Service", referring to the importance of the function that complies with the court in controlling the correctness of the procedure as a way of guaranteeing due process of law.
