The present notes are intended to contribute to the discussion about the configuration of Article 1560 from a historical-dogmatic approach. It analyzes the historical evolution of the interpretation of the contracts in general until decanting to the rules that adopted the different codes of the nineteenth-century to finish approaching the antecedents on the matter in the Projects of Civil Code and the Principles of International Law by Andres Bello.
