This study deals with the different disciplinary regime in the Brazilian penal system, instituted by Brazilian law No. 10, 792, which came into force on January 2, 2003, in order to make it difficult for criminalled factions. The objective of this study was to analyze, through doctrine, legislation and concrete cases, the effectiveness of this disciplinary regime in the country, in order to identify failures in the fight against organized crime, as well as to point out the violation of several rights and guarantees in the Brazilian prison system. In addition, it should be emphasized that this work presents the historical evolution of criminal law regarding the ways of punishment, the emergence of criminal factions, and its perpetuation throughout the national territory. The result of this study was that the institute referred previously has not achieved the success by which it was created, since the inmate exposed to this regime is hardly recovering, with the consequence of the actions of the prisoner being imprisoned. corruption of public agents as a factor of aggravation of the exposed problem.
