This paper analyses the effect of the buyer's knowledge, before signing or closing, about the falsity of one or more representations and warranties. It focuses on the case in which the parties do not address the issue in the contract. It holds that under Chilean law the actual knowledge by the buyer affects its ability to bring a claim for the breach of the representations and warranties.
