This article analyzes some of the tensions between the algorithmic transparency obligations that arose in the framework of the fourth industrial revolution, and intellectual property rights, making special reference to the trade secrets that may apply to artificial intelligence algorithms used for automated decision making and profiling. In this sense, new elements are provided to contribute to the discussion on the problem described and some solutions are proposed that allow for the balanced safeguarding of both: transparency, and intellectual and industrial property rights, from the perspective of Chilean law, making specific references to the law of the European Union.
