This paper intends to analyze the dispute over the redefinition of democracy produced in Argentina since 2003. To this end, a posfundacional political thought as theoretical position is adopted. The human rights policy, the relationship between the government and social movements and the discussion about the "mass media law" are developed along this paper. It is argued that the construction of meaning that kirchnerism has achieved is to understand it as a conflict, as a participation process and as a project, which is politically positioned far away from that neutrality in which other visions situate democratic institutions.
