A recent judgment of the Supreme Court of Chile, regarding video surveillance from balloons in two communes of Santiago, has reopened the issue of public safety as a criteria to restrict constitutional rights, including privacy. In practical terms, this criteria implies to admit intrusion of privacy by recording public and private spaces at once, to be compared with the legislative and judicial criteria weighting in constitutional, criminal and procedural criminal law.
