This paper argues that contractual liability and tortious liability serve different purposes and protect different interests. Therefore, the former belongs to the law of contracts and the proposition that both liabilities constitute a unitary legal regime should be rejected. This notwithstanding the possibility of an exceptional overlap of both regimes in particular cases. Yet from these exceptional situations no general rule of a unified regime can be deducted.
