The 1989 constitutional reform modifying article 5 of the Chilean Constitution set down a decisive criterion about the incorporation of international human rights law into the domestic legal order. This paper addresses the Constitutional Court prior and subsequent case-law to the reform. It distinguishes between the application by invocation in the action itself of international human rights law and the application of interpretative principles and criteria of international human rights law.
