This article is a revision of the main theories regarding the origin and primitive function of mancipatio, studying its economical and social functions and comparing these with the primitive pre-state organization of Rome. It concludes that mancipatio is a archaic ceremony aimed to give certainty to transactions of goods that belonged to the gentes, especially those that involved the transfer of productive assets.
